Disability Benefits For Professionals

Not being able to do your job due to a disability can be devastating. An accomplished career forms a core part of your identity, and not being able to engage in it — even temporarily — is a hard thing to face.

At Bolt Keenley Kim LLP, we know the importance of professional identity. Some of our clients experience a short-term absence from their job because of a disabling condition, whereas others must deal with the prospect of longer-term adjustments. Whatever your situation is, we will do our best to ensure that you receive the benefits you deserve under your employer's insurance plan. We have a proven record of doing so for clients in many different industries.

Supporting Your Career

Our attorneys have successfully won disability payments for many different professionals, all of them facing different challenges. Our clients include:

  • Technology professionals, such as software engineers and data scientists
  • Physicians, surgeons and nurses
  • Managers and other office workers
  • C-suite executives

Every professional has their own unique set of circumstances related to their condition and their line of work. Whatever your situation is, we will analyze it thoroughly and build a strong case on your behalf.

Addressing Pain

Some conditions are difficult for insurance companies to dispute. If you are a surgeon with a severe arm injury, they would be hard-pressed to say that you were fully capable of performing surgery.

However, other conditions give insurance companies more room to deny your benefits, especially when they relate to chronic pain. Our lawyers have fought aggressively — and successfully — for these clients too. Some of the conditions they have faced include:

  • Fibromyalgia
  • Nerve damage
  • Multiple sclerosis
  • Severe arthritis or osteoarthritis
  • Severe chronic back pain

Because these conditions rely so heavily on a person reporting their own symptoms, insurance companies will take every opportunity to downplay the accuracy of these reports.

What Will My Insurance Cover?

This depends on how your policy was written. Many insurance plans provide what is known as "own occupation" disability payments for up to two years. "Own occupation" benefits are available if you are unable to perform the normal duties of your chosen profession — they do not require total disability in a more general sense.

After two years, these policies often revert to "any occupation" benefits, which are only available if you are unable to work in any capacity at any job. However, some plans offer "own occupation" benefits for a longer period of time. We will review the details to see what you are entitled to.
